Thriving Student Achiever Contest: Official Rules and Regulations


ELIGIBILITY

The Thriving Student Achiever Contest ("Contest") is open to legal U.S. residents physically residing in the fifty (50) United States and the District of Columbia, who are the age of majority in their home state as of the Contest start date. This Contest is void outside of the United States, in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, all other U.S. territories and possessions, and wherever else restricted or prohibited by law. This Contest is sponsored by Solvay Pharmaceuticals Inc. ("Solvay"). Employees, officers, directors, agents, representatives of Sponsor, Ruder Finn, Inc., the legal, promotion and advertising agencies of any aforementioned entity, and their immediate family members and those living in their household, and each person or entity connected with the production or administration of the Contest, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity are not eligible. This Contest is subject to all applicable federal, state and local laws.

The Contest Submission Period ended on May 1, 2009, at 11:59 PM EDT (the "Contest Submission Period"). ALL ENTRIES MUST HAVE BEEN SUBMITTED DURING THE CONTEST SUBMISSION PERIOD. By participating, contestants agreed to be bound by these Official Rules and the decisions of the Judges and/or Sponsors, which are binding and final on matters relating to this Contest.


JUDGING AND NOTIFICATION

SolvayCARESSMScholarship judges based their decisions on applicants’ creativity, academic excellence, community involvement, financial need, and ability to serve as a role model for the CF community as outlined in the original Scholarship application. Recipients of the $2,500 scholarships were notified in June of 2009 (“Selected Contestants”). The winner of the SolvayCARESSM“Thriving Student Achiever” Scholarship $17,000 award will be based on qualified votes cast during the official voting period in the fall of 2009 (“Winner”). Notification of the Winner will follow the closing of the voting period. All decisions made and votes tallied by the judging panel are final.

Solvay reserves the right to alter the terms of this program without notice at any time.

During the Contest Period, Solvay will post a Contestant's Creative Submission, first name with last initial, photo, essay and list of honors and activities on www.SolvayCARESScholarship.com.

In June of 2009 the Selected Contestants were contacted using the information they provided on their application, signature of which indicated declarations of authenticity of information provided, original work of authorship, ownership of materials submitted, and publicity release forms. The Selected Contestants were provided with specific directions in their e-mail Winner notification on how to opt out of the Contest, if desired, by notifying Solvay no later than August 21, 2009.

Participating Selected Contestants’ applications and creative entries will be posted on SolvayCaresScholarship.com on September 15, 2009, and the voting to determine the SolvayCARESSM “Thriving Student Achiever” Scholarship Winner will commence. The “Thriving Student Achiever” Winner will be awarded a $17,000 scholarship in place of the $2,500 standard award via the receipt of a supplemental $14,500 award in addition to the original $2,500 award provided.


VOTING RULES

Please note that all of the following rules and procedures are subject to change at the sole discretion of Solvay Pharmaceuticals. Please read these rules carefully, since certain voting rules and procedures have changed from last year.


GENERAL VOTING RULES AND REGULATIONS

Voting opens to the public at 12:00 am on September 15, 2009, and closes at 11:59:59 pm on October 15, 2009.

ONLINE VOTING

To vote online: To vote online please go to www.SolvayCARESScholarship.com and register by providing your first name, last name and a valid e-mail address. To place a vote, click the “vote here” icon linked to a specific winner profile. Please note that you can vote for your chosen applicant one time for the duration of the campaign. This means one email address equals one vote. All duplicate votes cast by an existing registered user will be considered invalid and will be voided from the final voting record of the Thriving Student Achiever.


MOBILE VOTING

Call to Vote: To vote via phone call the toll-free number, where each of the 40 scholarship recipients will be assigned an identifier. Call 888-305-9808, and follow the instructions. Please note that the voting permits one call per telephone number for the duration of the campaign. All duplicate votes cast by an existing registered user will be considered invalid and will be voided from the final voting tally for the Thriving Student Achiever. NOTE: Votes cast via a mobile device as a text message cannot be cast as a call via the 1-888 number using that same cell phone number.

VOTING DISCLAIMER

Must be 13 years of age or older and a legal resident of the United States to vote. Online votes will be declared made by the authorized account holder of the e-mail address submitted at time of the vote. Solvay Pharmaceuticals ("Administrator") shall have the right to void any vote that appears, in Administrator’s sole discretion, to be an automated or duplicate vote and/or any other "hack" violating the voting rules or otherwise interfering with the administration of the vote. Administrator reserves the right in their sole discretion to withdraw the transmission of, or otherwise disregard, any such vote and/or permanently disqualify from any promotion any person it believes has intentionally violated these voting rules. Administrator may, in its sole discretion, extend the voting period beyond the publicly published voting deadline. Moreover, Administrator may, in its sole discretion, terminate the competition and voting at any point and declare a winner based on the votes up to that point, if it appears to Administrator in his sole discretion that the voting process has been so distorted by hacking or other interference that the results would not reflect actual valid votes should the competition and/or voting continue. Administrator and his respective officers, directors, employees, subsidiaries and affiliates assume no responsibility for: (1) any injury or damage to any person's computer relating to or resulting from entering or downloading materials or software in connection with this vote; or (2) telecommunications, network, electronic, technical or computer failures of any kind; or (3) inaccurate transcription of voting information; or (4) errors in any promotional or marketing materials; or (5) any human or electronic error in connection with the voting and/or tallying of the votes; or (6) votes that are stolen, misdirected, garbled, delayed by computer or telephonic transmissions, lost, or late.


CHARGES

Unless expressly noted, all services are offered without charge by SolvayCARESSM Scholarship, but standard text rates and other carrier charges may apply. The customer is liable for any mobile phone charges incurred (usage, subscription, etc) as a result of voting in the SolvayCARESSM Scholarship contest. Please consult your mobile service carrier's pricing plan to determine the charges for sending and receiving text messages.

SERVICE AVAILABILITY

The services are available on the following carriers: AT&T, Verizon Wireless, T-Mobile, Sprint, Nextel, Dobson, US Cellular, Virgin Mobile. Additional carriers may be added as they come available.


PRIVACY POLICY

Administrator will never, under any circumstances, sell or otherwise distribute your cell phone numbers to third parties. Administrator will never market to you directly any services for which you have not opted in, either by cell phone, text message or e-mail. Administrator will never distribute any personal information about you, including your phone number, name, billing information, or any other piece of identifying information.


CHANGES IN TERMS AND CONDITIONS FOR SOLVAYCARESSM SCHOLARSHIP VOTING

We may modify or terminate the SolvayCARESSM Scholarship from time to time, for any reason, and without notice, including the right to terminate with or without notice, without liability to you, any other user or any third party. We reserve the right to modify these Terms of Use from time to time without notice. Please review these Terms of Use from time to time so that you will be apprised of any changes.


SUBMISSION GUIDELINES

All Submissions are referred to collectively as the "Submissions." No Submission may depict any nudity, animal cruelty, harmful or illegal activity or substance, or offensive or obscene subject matter as determined by the judges in their sole discretion. No Submission shall portray Sponsor, its services or products in a negative light. All Submissions should be original, truthful and show creativity. All entries must be original works of authorship, created by the person who submits the entry. Contestants may not copy or otherwise plagiarize the Submission from any source, nor may the Submission include third party copyrighted material, such as text, music, photographs, or video snippets unless permission has been granted by the lawful owner of the copyrighted materials and proof of such permission is provided to Solvay. Additionally, in the event that any Contestant's creative presentation involves the use of photographs, Contestants are solely responsible for obtaining any consent(s) and release(s) from each person whose image is distinguishable in the photograph, including the consent(s) and release(s) of parents or legal guardians for images of persons under the age of 18 years. Contestants must certify to the Sponsor that such consent(s) and release(s) have been obtained. Contestants must hold all rights to their Submissions. Contestant agrees to indemnify Sponsor against any and all claims of infringement or violation of any third party rights for any use by Sponsor of Submission. If, in the sole discretion of Sponsor, a Submission constitutes copyright infringement or a violation of any other third party right or a violation of any ordinance, regulation, or law, the Submission will be disqualified.

Sponsor is not responsible for late, incomplete, void, corrupted, garbled, misdirected, or otherwise unintelligible or incompatible Submissions. Incomplete, garbled, corrupted or otherwise illegible Submissions are void and will not be accepted. Sponsor reserves the right to disqualify false entries or entries suspected of being false. Sponsor will not verify receipt of entries. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.

Selected Contestants and Winner will be posted on www.SolvayCARESScholarship.com.
